Article 228. Judicial Proceedings in Summary Proceedings Cases

  1. Summary proceedings cases are considered by the commercial court in accordance with the general rules for adversarial proceedings, stipulated in this Code, subject to the special rules, established in this Chapter.
  2. Summary proceedings cases are considered by a single judge within one month at most from the day of receipt of the statement of claim by the commercial court, including the time for the preparation of the case for judicial proceedings and for the delivery of a decision on the case.
  3. In the ruling on the acceptance of the statement of claim for consideration the commercial court points out the possibility to consider the case through summary proceedings and fixes a fifteenday term for the parties to object to the case consideration through summary proceedings and to submit other evidence or a statement of defence.
  4. If a case is considered through summary proceedings, the court session is held without the summoning of the parties. The court examines only the written evidence, as well as the statement of defence and explanations on the merits of the stated claims, submitted in the written form, as well as other documents.
  5. If the debtor objects against the stated claims, and also if a party objects against the consideration of the case through summary proceedings, the commercial court issues a ruling on the consideration of the case in accordance with the general rules of adversarial proceedings, established in this Code.
